Terms of Service

These Terms of Service (“Terms”) govern your use of the jonastudios.com website (the “Site”) and any photography or videography services booked with Jona Studios (“Jona Studios,” “we,” “us,” or “our”). By using the Site or booking a session with us, you agree to these Terms. If you do not agree, please do not use the Site or book a session.

Use of the Site

You may use the Site to learn about our services, view our portfolio, and submit booking inquiries. You agree not to misuse the Site, including by attempting to gain unauthorized access to it, interfering with its normal operation, or using it to transmit unlawful, infringing, or harmful content.

Bookings, Retainers & Payment

Submitting an inquiry through the Site does not guarantee a booking. A session is considered confirmed once we have agreed on the date, scope, and price, and — where applicable — received any required retainer or deposit. Full payment terms, including the balance due date, will be communicated directly at the time of booking. Retainers and deposits are generally non-refundable, as they reserve our time and turn away other bookings for that date.

Cancellations & Rescheduling

We understand that plans change. If you need to reschedule, contact us as early as possible and we will do our best to accommodate a new date, subject to availability. Cancellations made with limited notice, or last-minute weather-related cancellations for outdoor sessions, may be subject to a rescheduling fee in addition to any non-refundable retainer already paid. Specific timelines will be confirmed in writing at booking.

Image Delivery

Edited photographs and/or video are typically delivered via an online gallery or file-transfer link within the turnaround window communicated at booking. Turnaround times can vary based on session type, season, and scope of editing, and we will keep you updated if a delay is expected. Raw, unedited files are not included as part of standard delivery unless separately agreed in writing.

Copyright & Image Usage

Jona Studios retains full copyright and ownership of all photographs and video created during a session, as the creator of the work, in accordance with U.S. copyright law. Upon full payment, clients receive a personal-use license to download, print, and share their delivered images for non-commercial, personal purposes (including social media sharing with appropriate credit where possible).

Commercial use of delivered images — including use in advertising, branding, product packaging, or resale — requires a separate written commercial license agreement. Clients may not sell, sublicense, or claim authorship of images, and may not use third-party editing or AI tools to materially alter delivered images in a way that misrepresents Jona Studios’ work.

Portfolio & Marketing Use

Unless a client requests otherwise in writing prior to or at the time of booking, Jona Studios reserves the right to use images and video from a session for portfolio display, marketing, social media, website content, and promotional purposes. Clients who prefer their images not be used publicly (for privacy, professional, or personal reasons) may opt out at any time by notifying us in writing.

Liability

While we take great care with our equipment and backup practices, Jona Studios’ liability for any claim arising from a session — including equipment failure, data loss, or an inability to complete a session due to illness, accident, or other circumstances beyond our reasonable control — is limited to a full refund of fees paid for that session. Jona Studios is not liable for indirect, incidental, or consequential damages. Clients are responsible for the safety of their own property and guests at any session location.

Model Release

By booking and participating in a session, clients (and, for minors, their parent or legal guardian) grant Jona Studios permission to photograph and/or film them and to use those images as described under “Portfolio & Marketing Use” above, unless a written opt-out has been provided.

Intellectual Property of the Site

All content on the Site — including text, design, layout, and the Jona Studios name and logo — is the property of Jona Studios and may not be copied, reproduced, or used without prior written permission, other than for the personal, non-commercial viewing of the Site.

Governing Law

These Terms are governed by the laws of the state in which Jona Studios is based, without regard to its conflict-of-law principles, and applicable United States federal law. Any dispute arising from these Terms or a booked session will first be addressed through good-faith direct communication between the parties.

Changes to These Terms

We may update these Terms from time to time. The “Effective Date” above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms. Terms agreed to at the time of a specific session booking will continue to govern that booking.
